1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Pulse, a marketing analytics dashboard operated by Uniqbe ("Uniqbe," "we," "us," or "our"). By accessing or using Pulse, you agree to be bound by these Terms. If you are using Pulse on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Pulse unifies marketing performance data from Google Search Console, Google Ads, and Meta Ads (Facebook & Instagram) into a single dashboard, and provides AI-assisted natural-language querying of that data. Pulse does not place ads, manage budgets, or make changes to your connected ad or analytics accounts — it is a read-only reporting and analysis layer on top of the accounts you connect.
3. Accounts & Eligibility
Access to Pulse is generally provided by invitation from an administrator, though an account may also be created directly where self-service signup is enabled. Either way, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate account information and notify us promptly of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use Pulse for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to Pulse, other users' accounts, or any connected third-party account
- Reverse engineer, decompile, or attempt to extract the source code of Pulse, except as permitted by law
- Interfere with or disrupt the integrity or performance of Pulse or the data it retrieves
- Use Pulse to process data from a Google, Meta, or other third-party account you are not authorized to access
- Resell, sublicense, or provide Pulse to third parties outside your organization
5. Connected Third-Party Accounts
When you connect a Google or Meta account to Pulse, you represent that you are authorized to grant Pulse access to that account's data under the applicable platform's own terms (Google's and Meta's respective terms of service and developer policies). Pulse acts solely as a conduit to retrieve and display data you've authorized — we are not responsible for the availability, accuracy, or policies of Google, Meta, or any other third-party platform. You can revoke Pulse's access to a connected account at any time; see our Privacy Policy for instructions.
6. Your Data & Content
You and your organization retain all ownership rights to the marketing data retrieved from your connected accounts and to any content you submit to Pulse (including AI queries). You grant Uniqbe a limited license to process, store, and display that data solely to provide and improve Pulse for you and your organization. We do not claim ownership of your marketing data.
7. AI-Generated Content
Pulse's "Ask AI" features use Anthropic's Claude models to generate natural-language summaries and answers based on your connected marketing data. AI-generated content may be incomplete or inaccurate and should not be treated as financial, legal, or professional advice. You are responsible for independently verifying any AI-generated insight before relying on it for business decisions.
8. Intellectual Property
Pulse — including its software, design, and branding — is owned by Uniqbe and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in Pulse other than the limited right to access and use it as permitted here.
9. Service Availability & Changes
We aim to keep Pulse available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of Pulse at any time, including features that depend on third-party APIs (Google, Meta, Anthropic) that may change or become unavailable outside of our control.
10. Disclaimer of Warranties
Pulse is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that Pulse will be error-free, secure, or uninterrupted, or that data retrieved from connected third-party accounts will always be accurate or current.
11. Limitation of Liability
To the fullest extent permitted by law, Uniqbe will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of Pulse, even if we have been advised of the possibility of such damages.
12. Termination
We may suspend or terminate your access to Pulse at any time if we reasonably believe you have violated these Terms, or for legitimate business reasons such as discontinuing the service. You may stop using Pulse at any time. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, and Limitation of Liability) will survive.
13. Governing Law & Disputes
These Terms are governed by the laws applicable to Uniqbe's place of business, without regard to conflict-of-law principles. If a dispute arises, we ask that you first contact us at info@uniqbe.com so we can attempt to resolve it informally before pursuing any other remedy.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of Pulse after changes take effect constitutes acceptance of the updated Terms.
